how to divorce someone that is in mexico
My boyfriend is married to someone from mexico where he is from. He wants to get divorced how do we go about getting it filed. He hasn't been there since 2001 and we have a child together and would like to get married

You need to have him take this matter forward, and he needs to hire an attorney and file for divorce. if he has been here for over 1 year, then he should be able to file a divorce action in New Jersey.

To file for divorce in New Jersey one of the married couple must have lived in New Jersey for a year. If the other spouse lives in Mexico, then a copy of the divorce complaint is served upon that spouse by either the local sheriff or police or someone hired for that purpose.
