Legal Question in Criminal Law in Michigan
False allegations of Assault
My girlfriend was head butted by her brother. I was informed that he did it and I went to his house. I never stepped foot on his property but he came out with his girlfriends uncle and stood behind him yelling and arguing with me. I told him if he touched his sister again I would beat him up. His sister had already called the cops to press charges against him for what he did, well the prosecutor denied it. I got a phone call yesturday that the police want to get a statement from me because her brother is saying I assaulted him. So I agree to me, because I never touched the guy. Well I get three tickets, one for simple assault, one for phone hassarsment *I called him and he told me to come over because he was going to whip my arse*, and one for DWLS. I understand I was DWLS but normally I don't and no officers saw me nor did they pull me over. I am just dumb founded. I told the cops that I wanted a lie detector test because I never touched that guy. But apparently his girlfriend is good friends with the Lieutenant of that police station. So that is why he never got charged with assault on his sister but I got charged. Is there anything I can do. I mean I would man up if I did anything wrong, but this is just immature and childish.
