child custody
my brother & his ex have a son. She got sole physical custody. He pays child support faithfully. She is gravely ill. Does he automatically get his son if she dies?

Your brother should immediately work out a consent order whereby if the ex becomes unable to function as a caregiver/mother for the child or if she dies, that custody automatically goes to your brother. It sounds like they get along well enough to do this without the necessity of a motion before the judge. It would probably be best if a family law attorney drafted it to make sure it is done properly. William S. Stern
