My landlord stopped giving us leases a couple of years ago. He's neglecting the property and refuses to replace the windows, which needed to be replaced years ago. I just talked to the manager, and he told me that the reason the landlord stopped letting us sign leases was so he could evict anyone who complained about the conditions too much. The manager also said ''the landlord can evict you without having a lease if he doesn't like the way you dress''. Is that true? I'd like to get a city inspector to come in and try to force him to replace my windows but I don't want to get evicted for doing that. Can he really kick any of us out for no reason and if we challenged the eviction in court, could we win?

Your lease can be terminated by either you or the landlord with 30 days notice. This is different from eviction, but if the landlord were to give you 30 days written notice of terminating the lease, you could be evicted if you do not move out after that 30 days.

If the condition of the property is as bad as you describe, you would probably benefit from finding a new place and giving 30 days notice to your landlord.

You are a month to month tenant who could be evicted upon 30 days notice. You could also leave upon 30 days notice, which it sounds like you should consider given the state of disrepair the place is in. Visit www.kliszlaw.com to discuss further. Tim Klisz
