Legal Question in Real Estate Law in Michigan

Purchase Agreement

My 74-year-old mother signed a purchase agreement to sell her home. A week later she was rushed to the hospital and underwent a 7.5 hour surgery to remove a malignant brain tumor. We need more time to get her out of the house (for home physical therapy, etc), and the buyer refuses to give us any. Can we get out of this agreement? FYI: You could tell just by looking at her that there was sometime wrong with her at the time she signed the contract.

Re: Purchase Agreement

Yes, you could argue that she was not in her right mind at the time of signing the contract. You will need some medical testimony to corroborate this assertion. I would hire an attorney to handle this if I were you. If you have any further questions, please contact my office at (248)851-3171.

Re: Purchase Agreement

A purchase agreement is the most important document in the sale of real estate - it controls the terms. While the purchase agreement would have to be reviewed in that regard, to assess its enforceability, if your mother was not in her "right mind" due to medical reasons, the contract might be voidable.
