Legal Question in Wills and Trusts in Michigan

How to get copy of trust, need answer asap!

Mom died in May 2006. Just found out from dad that I was listed as successor trustee on mom's trust. He said this was a mistake and he should have been listed as successor, and I was suppose to be listed as successor trustee after him (once he dies). Dad said he is working with an attorney to get this changed. Original paperwork was filed 9-10 years ago. Dad said he can't find original attorney, even though I find him listed on the internet. Dad won't show me a copy of the trust. He did say trust is now irrevocable. I called county probate and they do not have a copy of trust or will. What are my legal rights? Can he remove my name if trust is now irrevocable? How can I get a copy of the trust document? Will attorney that originally drew up paperwork give me a copy since I'm listed as successor? Dad is planning on getting remarried this month and has stated he will revise all trusts to include new wife. Entire family is upset since money in trust came from mom's side of the family, and after 51 years of marriage we don't want $$ going to new wife. Help!

If you are serious about needing help, you should consult with an attorney, face-to-face with the relevant documents, as soon as possible. The questions you pose would require a lot of time to answer, and that is well beyond the scope of this site. This site is not a substitute for substantive legal advice. Attorneys who respond on this site donate a little of their time to give some general legal information/guidance to individuals/consumers. For the type of issues you are facing, you need a comprehesive consultation with an attorney.

Good luck.
