Legal Question in Family Law in Minnesota

child custody

My ex-wife has custudy of our 3 children, ages 16, 15, 13. The ex is remarried to a abusive man and my 15 year old wants to get out of there. How would I go about getting custudy of her. I am on a very limited budget thanks to MN child support amounts. Is this something I could do without legal help?

Under Minnesota law a child can never decide where he/she wishes to live. To seek custody, you must file a Motion and demonstrate that the child is endangered physically, emotionally or developmentally AND that the benefit of a change outweighs any harm. It is a very high standard.
