If my ex has requested copies of my last two years of taxes, do I have to send them?

The answer to that question depends on a lot of factors. However, most divorce settlements include a clause requiring both spouses to exchange certain financial documents upon request. If you have a copy of your settlement, read through it to see if yours includes such language.

If it does not, the answer to your question would depend largely on why your ex is asking for the materials. If there is an ongoing child support contest you may be legally required to turn over the papers within a relatively short time period. Other court cases may also require you to turn the papers over. You always have the right to clarify why the papers are needed.

Minnesota Statutes Sec. 518A.28 allow either party to request income informaion "at any time after an action seeking child support has been commenced or when a child support order is in effect." It allows that the party kmaing the request may ask for a copy of the party's most recent federal tax returns that were filed with the Internal Revenue Service. The party from whom the information is requested must provide a copy of

the tax returns within 30 days of receipt of the request unless the request is not made in good

faith.

A request under this paragraph may not be made more than once every two years, in the absence of good cause.
