Legal Question in Civil Litigation in Minnesota

underage driver involved in traffic accident with a rental car

I rented a car and let my younger brother drive it. While driving this car he struck an animal causing damage to the car. The rental company has submitted a bill to me of $19,000 for repairs, in lieu of paying the repairs, they stated that I can purchase the car for the same amount. This amount seems excessive for the repairs. I understand that I didn'

t have a right to let my brother drive. Any suggestions would help.

This response is for general information purposes only and does not create an attorney-client relationship.

I was consulted a few weeks ago by a client with a similar problem, but it was only a small dent. After our conversation he decided to take the car and have it repaired himself before he returned it to the rental place. It doesn't sound as if that would work for you, however.

This sounds like a serious enough problem to go directly to a law office with. You can have a lawyer go through your rental contract and look for loopholes. Depending on the rest of your situation, perhaps a bankruptcy would be an option. Another thing that should be looked into is whether your regular automobile insurance might cover rental vehicles; and did you get insurance as part of your rental contract, and does that cover anything in these circumstances? Your lawyer could help you figure out the answers to these questions.

If you had symtoms of a heart attack you would go to a doctor wouldn't you? Asking a few questions on the internet wouldn't be enough. From a legal perspective this is similar. Get yourself to a lawyer.
