Legal Question in Workers Comp in Minnesota

Unhappy with Dr and work

I have been on work restrictions for 4 months due to cervical herniations and other problems. My employer has laid me off but now the dr I see has lifted my restrictions and I am no better and still in severe pain. I get burning pain and headaches just holding my head down. Can I quit my job and still be able to keep my worker comp claim, because I know that I cannot continue to work in this pain regardless what the dr says? I know the dr works for them and he is sympathetic at all. I am in pain everyday and cannot sleep at nights.

Re: Unhappy with Dr and work

The big problem with quiting the job is the employer will argue that you failed to return to work and therefore the cap should apply. Did you have an operation? What kind of work do you perform? Do you have any permanent restrictions? Feel free to contact me directly. My contact information is a www.hhpfirm.com
