wrongful death

My brother was a passenger in a car accident, the vehicle spun out of control and was struck on the passengers side by an 18 wheel tractor trailer. Would I be able to sue the trucking company?

The answer is "it depends". The wrongful death statute sets out the various people who are entitled to file suit. In any event, you really should consult with an attorney in person. Yes, most definitely as a passenger he would have a strong case. Was he injured? In any event, he should not talk with any agent of the insurance company or companies until he has consulted with an attorney. Most attorneys, like myself, handle these cases on a contingent basis which means that you don't pay the lawyer up front. Instead, the attorney takes a portion of the settlement which is usually from 25 to 33% percent.

You may have a claim for wrongful death along with any other "beneficiaries" (i.e. parents, other siblings, children).

An attorney can help you by (1) investigating the accident to determine fault, (2) determining all available sources of recovery and (3) utilizing the litigation system to obtain money from the sources of recovery.
