fear for my children

i dont know where to turn,

i am seperated from my wife (both 38 yrs old), her 20yr old boyfriend is physicly abusing her and verbaly abusing my 3 kids. there are drugs and alcolhol involved, as well as neglect. all of the money goes to the boyfriend and kids are getting minimal food. mother is homeschooling and is not even doing that. i am in fear for my kids and dont know what to do or where to turn.

One option would be for you to immediately consult with an attorney and hire an attorney to represent you. It may be best to file a Petition seeking a Child Protective Order under which you would obtain physical custody of those children and Court Orders would be entered for their protection. An Ex Parte Order is entered the same day that you file the Petition and then a Court date is set upon which it is decided whether to make that Order a Full Order of Protection. Of course, it sounds like you also need to file a Petiton for a Dissolution of Marriage. In that case you could file a Motion Pendente Lite, and obtain a Court Order granting you custody of the children pending the divorce proceedings. But, if you chose to take this approach, it would be a lot longer before you could obtain any relief or any protection for the children.
