buy/sell home between spouses

can my spouse sell his house, now rental property, buy my/our house and avoid capital gain taxes?

Perhaps the seller could avoid or reduce capital gaisn taxes by a purchase, such as you suggested. It would require more facts to determine the likelihood of this tax avoidance plan. Your accountant, or the person who prepares your tax return(s) may be able to tell you.
