Legal Question in Real Estate Law in Missouri

Last year we were looking for a mortgage, we went with a lender. Appraisal came back and the lender recommended a non-traditional loan, we declined to move forward. Now we are getting a letter from the appraiser requesting payment, we never received this appraisal are we obligated to pay this?

Whether you owe the appraiser comes down to what agreement you had with the potential lender. Unfortunately most agreements include a provision wherein the buyer agrees to pay appraisal fees. If you chose the appraiser you are more likely to be found liable. if the lender chose and hired the appraiser, then they may be liable. If you signed the standard form that most apprasisers have buyers sign before they do the inspection, you may hve agreed to pay the appraiser if the lender doesn't. Technically, if there is no agreement, you and the lender each owe the appraiser if you consented to the appraisal.
