Legal Question in Workers Comp in Missouri

Was it caused by the job?

Passed out at work. Recieved facial laceration, dislocated and fractured shoulder.

Was off work. Received workers comp pay, medical bills and physical therapy paid by workers comp.

While at hospital had an eeg. ''eeg showed abnormal recording showing non-specific subcortical proximal discharges,although not specific of seizures...Syncope likely secondary to seizure''

the terms ''not specific'' and ''likely'' would indicate to me that it is not certain that i actually had a seizure.

I am 44, never had a seizure. I am worried that if i pursue a settlement that they may change their mind about it being work related and i'll have to repay the money and medical bills. Is this something that i would have to worry about or does the fact that it was or that it was not a seizure even matter?

If the company has paid work comp benefits, then they are admitting that this condition is work related. Pursuing your benefits further can not result in a repayment by you, unless the payment was in error, and I have no indication from your post that that is the case.

Without seeing your medical records, it is impossible for me to give you more specifics about your claim! I would suggest, however, that given the current status of Workers' compensation in the capitol, that you file your claim sooner, rather than later, and hire a qualified attorney quickly!
