Legal Question in Workers Comp in Missouri

FMLA while on Worker's Compensation

I hurt my back lifting heavy boxes at work. My employer has been very nice, but put me on FMLA and also filed worker's compensation which thus far is handling everything. I know FMLA protects my job, but doesn't worker's compensation protect it so I would not need to use FMLA at this time?

Re: FMLA while on Worker's Compensation

If the treating doctor says that you cannot work during yoru healing process, you should be on Temporary Total Disability (TTD) and should be getting paid aportion o fyour wages or salary. On FMLA leave you do not get paid. Are you being paid? If not, then you may need to consult with an attorney to assert your rights.

Good Luck
