Re: a law question for a project

The difficulties and harassment that Charly faces in Flowers for Algernon comes about because of his rapid increase in intellect and abilities. Many forms of harassment are not illegal. To be actionable, a claim for harassment in the workplace must be based on an illegal factor, many of which are based on constitutional grounds. Those are areas such as age, race, national origin and religion. In other words, the employer can harass an employee because he doesnt like him, but the employer cannot harass the employee because of his race. Other protected areas are set out in state and federal laws, such as prohibitions on harassment and job discrimination on the basis of pregnancy, filing of workers compensation claim, and whistle blower situations. The remedies or consequences of such behavior varies. If a co-worker or supervisor is at fault, that person may be fired. If the organization condones the behavior, the injured employee may have an action for monetary damages or reinstatement to a lost job.
