Last name change in a second divorce

I am a wife to be. My fiancee's x-wife was married for the second time and now seeking the second divorce. She has taken back my fiancee's last name but still married to husband #2. My fiancee and I do not like that she is using the last name from her 1st marriage. Does my fiancee have any legal say if she is allowed to use his last name???? Remember---she is still not legally divorced from husband #2. Thanks for your help.

The short answer to you question is NO, YOU CANNOT KEEP HER FROM USING HIS NAME.

Your fiance's name is his ex-wife's last legal name prior to this marriage. As part of her divorce proceedings she has the right to resume use of her prior name. It won't be her LEGAL name until the decree is entered ordering the name change, but she really cannot be stopped from using the name.
