Legal Question in Real Estate Law in Nebraska

Taking my landlord(who ismy brother &is an attorney) to small claims court.

My brother and i had an verbal agreement to repair/replace an front door. He had hired an repairman from repairs-r-us who left an closet door on an front entry door with no locks and cut the security wires on my door. after complaing my brother told me to find a repairman and he will pay. i found someone(my brother talked to him and agreed to pay him. I sent a certified letter to my brother demanding my money. He sent a eviction notice along with a bill(closet door) for damages i did not or was not aware of. I am taking him to small claims court for $379. my brother is an attorney and thinks he is unouchable and can not lose any legal cases including this. Can i sue him for punitive damagages for retaliton on the eviction notice? the funny part is we dont have a lease.

Nebraksa does not allow punative damages. Your brother will probably move the case out of small claims court into County court, where you should hire an attorney to represent you.
