Child support and Medical Insurance

I am currently paying child support for my soon to be ex-wife who lives with our children in North Carolina. I recently found out that since I am paying for the children's medical insurance each month that is automatically deducted from my child support payments. I am currently paying $825 a month. I am wondering how I can reduce the payments since I am paying $240 a month for medical expenses for my children.. I do not have much money since most of my paycheck goes to child support. What is the best inexpensive way to contest this matter? Thank you!

Get your wife to agree to it in the Decree of Divorce or have a temporary agreement filed with the judge (Stipulation and Order). Otherwise, ask for a credit if you go to trial on the divorce. You should get a credit for $120, as you are paying your soon to be ex-wife's half.

You need to isolate the cost of the health insurance for just the children; not you and the children. Once you have a document that proves that amount, you can ask the DA, if your case is in child support court, to offest your obligation (reduce it) by one-half of the premium cost.

You may need to speak to your caseworker, if this is a DA case, and have your worker put it on calendar or ask for it to be handled administratively.

If this isn't a case with the DA, then make sure you get this offset in the Divorce Decree of don't sign it.
