Legal Question in DUI Law in New Hampshire

1st offense 2nd offense 3rd offense

i had a 1st offense in nh in may of 2000 and one in ma. in may2002 the ma. one was settled as a first offense and the nh one was more than 7 years ago. I recently got pulled over in nh and refused a breath test, will they charge me wit a 3rd offense or 2nd or 1st , can i beat this case in any way?

You will lose your driving privileges as a result of failing to take the breath test. This is separate from the driving under the influence charge. As to second or third offense, this will take some detailed analysis of changes which happened in the law during those years. You should hire an attorney to analyze the legal issues. As to your chances of winning, it is impossible to respond as the facts relating to your stop, encounter with the police officer and results, will require a careful review and analysis. DUI cases are not easy to win, but sometimes there is a break in the chain which opens an opportunity to either win the case or negotiate for a lesser charge.
