Legal Question in Wills and Trusts in New Hampshire
My cousin's father passes away, and the person he left in charge of everything is his sister... his sister does not get a long with many of their family memebers. What can my cousin do about his fathers passing in regards to the will? He has no idea who the lawyer is, and his aunt said to wait for the lawyer to call them. She has told him that she wanted him to take over the loan payments and get the house under his name.. but they have no since spoke about it.. ( I have a feeling the house loan is over the price she can sell it for..)
So dealing with someone who is not all that close to the family and would steal from her family.. what would you recommend for my cousin to do?? Its been 60 days now with nothing. do lawyers usually call whoever is on the will or should my cousin try to find out who the lawyer is and call?
1 Answer from Attorneys
The first step is to go to the probate court in the county where the estate is filed and review the entire file. Some of the answers might be on the record once the will or supporting materials are examined. After that, a discussion with the attorney representing the estate might provide some level of comfort.
The next step would likely be for your cousin to hire an attorney experienced in this type of matter as it sounds like there's going to be a bit of family tension in dealing with the estate. It is important to make sure that the house is properly maintained and that the mortgage does not fall behind in payment.
