displaying photo of house on real estate site

i'm starting an internet real estate listing service. if i photograph a house displaying a realtors 'for sale' sign, can i post that photo on my site with a link back to the listing agents website without anyones permission to do so?

You may be violating the trademark rights of the realty agency if you are displaying their marks in your photos as part of your online business. At the very least, you would want to include appropriate disclaimers on your website clarifying that you have no connection to the realty agency. My sense is that you would have difficulty obtaining the consent of the agency to use their marks.
