i have 4 felony charges

1 1st degree

1 2nd degree

2 3rd degree

prosicutor is willing to do probation

If you to plea out to get probation. If you are getting a probation offer on a first degree case, I'd jump at that really quick. Even if you have a good case, the risk is just too great.

I would need to discuss your case with you in more detail. On any felony charge you are well advised to consult with an attorney before accepting any plea deals. It is extremely unusual for probation to be offered on a first degree felony charge - in fact I don't think I have ever heard of such a thing. On a first degree felony charge there is usually a presumption of many years in state prison upon conviction. I really think you need to speak to a lawyer before you go any further on this case. There is a sent. guideline. !st & 2nd degree crimes have a presumtion of incarceration. It appears that you may not be qualified for probation.
