Legal Question in Criminal Law in New Jersey

My son was charged with violation of NJS 2C:33-4 A. The complaint should have charged him with NJS 2C:33-4 C. There was no communication of any kind with the girl - just a couple of acts of sitting on the curb across the street from her house and showing up on her beach, which is 3 blocks down from ours. Can the charges be thrown out since the complaint lists the wrong section of the harassment statute?
