Legal Question in Family Law in New Jersey

Hello,

I have joint custody of my daughter and I have her every weekend. Her mother and I were never married and my daughter's last name is hyphenated. It is her legal birth name. I have on going problem with her mother not using my daughter's full name (dropping mine) when registering my daughter with doctors, pre-school, etc.. She is not even noting me as an emergency contact or filing me on the Privacy Act forms with the doctors. Is this legal? If not, what can I do about it?

Thank you

Your best option would be to file a Motion and get a Court Order to get her to do what she is supposed to do. You might be able to do this yourself, but most people choose to have an attorney assist them with this sort of application to be sure it is done correctly. Keep in mind that this advice is given based on the little bit of information that you have provided in your question. My advice may change based on other information. Further, no one can rely on advice from an attorney who has not been retained. You cannot rely on this advice because we have not personally met and you have not retained me as an attorney. If you have not already done so, you should immediately meet with a Family Law attorney for a full consultation before you take any further steps. You may feel free to call me at 856-546-8010 to discuss this matter in more detail. If you do so, mention Law Guru and your first one hour of time will be free. Good luck! Rob Gleaner
