Legal Question in Family Law in New Jersey

Reasonable Visitation

I have full custody and have been divorced for 4 years. What is considered reasonable visitation? My divorce papers do not state any specific amount/times of visitation and my ex-husband has gotten into the habit of stopping over my house whenever he is bored and disrupting our routine... when I asked him to just see her every other weekend he said that I was denying him a 'relationship' with his daughter.

Would I need a lawyer to go back to court to have visitation change/child support revaluated or can I do that at the courthouse myself?

Re: Reasonable Visitation Times

I do not think the main issue here is the amount of time; the issue is the timing. Everyone, especially your daughter, is entitled to know what the schedule is. It is unfair for your ex to expect you and your daughter to drop everything you are doing to accomodate his irregular schedule. Whether he gets every other weekend or any other schedule, it needs to be fixed and all parties need to comply with it, as well as can be expected, leaving room for amicable modifications when agreed to between the parties, in advance. You cannot say what is "reasonable" because it is different for all situations and changes over the years as your daughter grows older. You can certainly try to get this done yourself by applying to the Family Court in your county. However, I would suggest that you consult with a lawyer before you do so. Keep in mind that this advice is based purely on the little bit ofinformation that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not

retained an attorney, you may want to contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be

able to rely on the advice. If you call me, [856-546-8010] mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner
