Legal Question in Family Law in New Jersey

Stepfather Adopting??

I have a 6 year old whose father has been absent for 4 yrs. now. My husband has been with us since my son was 6 mths. He would love to adopt him. Is there any way to do this? I don't know how to even contact the natural father because I don't know where he is. Can you please let me know if there is any chance of the adoption happening and if so where do I start?

Re: Stepfather Adopting??

Your husband can file a petition to adopt your child. There must be a good faith effort to find the father. I find people all the time using a

website available only to lawyers and law enforcement.

You husband could oppose the adoption, but given his long absence it seems unlikely. If he opposes

the adoption there is a sound basis for a judge finding that the father abandoned his parental rights and that they should be terminated by allowing your husband to adopt your child.

Stepfather adoption

In my opinion, it is likely that a Judge would approve the adoption, even if your ex appeared and objected, in light of the circumstances that you have described. If your ex cannot be found, there is a procedure to advertise in a newspaper that circulates in his last known community. Keep in mind that this answer is based on the little bit of information that you have given me and the answer might change based on other information. Further, you can only rely on legal advice from an attorney who you have retained. Feel free to call me at 856-546-8010 to schedule an appointment.
