Legal Question in Personal Injury in New Jersey

I was involved in a minor accident in New Jersey that was my fault-no dispute of that. An ambulance was summoned for the person I hit due to back pain, but they then refused treatment. I've since followed up with both insurance companies and the person has not initiated any treatment or pip paperwork. Is a court hearing mandatory in New Jersey even though treatment was refused and there were no injuries, just because it was initially reported as such? We keep getting told we have to appear just to even settle the ticket. Can my spouse be summoned as a witness even if they were not even there?

Hi,

I always ask my clients not to speak with the booker, baker, and candlestick maker about their law questions. Were you issued a summons for any traffic violations in connection with this accident?

If not, a court appearance is not mandatory.

If a personal injury claim is commenced by the other driver, you may wish to turn over any letter you receive to your own insurance company. Please do not speak with anyone about the details of this accident, except for representatives of YOUR insurance company.

I hope you didn't give a statement to the other driver's insurance company. Mum is the word from now on.

Good luck.
