can a married couple legally establish seperately, a homestead in two different states such as wife in NJ and husband in FL, if so are there tax consequences

yes they can, and yes there are. big and sometimes bad tax consequences.

if this couple has any significant assets, and especially if they are older, then they should consult a tax and estate planning attorney.

I do not do this kind of work. I have several friends who do.
