Legal Question in Traffic Law in New Jersey

3rd Ticket in 2 month

I have had a good record for past 9+ years, in 2006 I have got the 3rd ticket for speeding. The first ticket I pleaded guily not knowing it was 4 point (thought it was 2 point, so I have 4 points on license. The second ticket I am apprearing in court and have very good chance of reducing it to zero point. Now I got a speeding ticket today which is 4 point ticket. What are the chances that I can reduce this from a 4 point to zero point? Do I have to hire an attorney? The ticket is in North/Central NJ.

Under the guidelines of the Administrative Office of the Courts, a municipal prosecutor is allowed to go down one level in reducing points on a ticket, so if you have a 4 point ticket then he can offer you a two point ticket. However, if you go with a lawyer, the municipal prosecutor will often go down two levels, from 4 points to 0 points for example. Since you already have 4 points on your license, I would recommend that you hire a lawyer for this new 4 point speeding ticket. Your message is not clear, but I can tell you the following.

There is no guarantee that you by yourself can convince the Prosecutor and police office to reduce a 4 point speeding to zero points. There is no guarantee that you with an attorney will be able to do this, either , but I would hope that a good lawyer will be able to help you do this.

Having a lot of tickets in a short time period will make it more difficult, too.

You can avoid the points with an attorney. You should know that there is a limit on the number of no point dispositions that you can negotiate, with each moving violation it becomes more and more difficult to obtain a deal in which you will receive no points.

You will have to drive less fast or you will be suspended from driving by the division of motor vehicles. Twelve points is an automatic driving suspension but suspensions are sometimes given where a person appears to be driving out of control.

Protect your valuable driving license. You may find it hard to believe but you are on the road to being completely screwed by the division of motor vehicles. Call me if you like.

The answer depends on which court your will be contesting your ticket in. If it's Secaucus for example, you may have a very difficult time-even with a lawyer. If I know the name of the court, I will guarantee that I will knock-off the points. If it's a court where this is more difficult, then I can't guarantee it. Tell me which court you'll have to appear in and if it's one where things are not so tough, then I'll give you all your money back if I can't remove all of the points, guaranteed. How's that?
