Legal Question in Traffic Law in New Jersey

Do I have a chance at getting my parking ticket dismissed?

I recently received a ticket for parking in a "No Parking- Certain Hours" area. The whole block that I parked on does not have any sign posted stating this. The only sign in front of me was 530 feet (about 3 blocks) from where my car was parked. The other was behind my car about 350 feet (about 1 1/2 blocks). I did't see either of these signs until after I got the ticked and went out searching for them. Even then they took about 15 minutes to find because the signs are so worn down and faded that all you can see is "Wednesday 6AM-4PM" in red letters. The rest of the sign is illegible. I have a scaled map showing the signs and my car at the time, overlapping pictures of the block I parked on, and the faded signs. Is this enough to get a dismissal?

Fighting a parking ticket is tough because most of the time the cost of the fine does not warrant the cost of a lawyer to assist you. In fact, most of the time, even if they were wrong to issue you a ticket (as appears might be the situation here), the cost to miss work to attend the court hearing would offset the savings from the ticket.

That said, if you are free, and have the time, and dont mind the potential time it might take, then you seem to have a good chance, and at least a valid argument. Many times (though it depends on the prosecutor) if you have a valid legitimate reason to fight a parking ticket, you have a good chance of winning.

It is really up to you in terms of making the cost-benefit assessment on your own.

Good luck!!
