catholic school debt

hi- i owe tuition to my daughters catholic school from last year. i spoke and agreed to make payment but never got back to them so they had a lawyer contact me for collection original amount was 5700.00. lawyer was asking for 7700.00

i explained i was never notified of any acruing interest or charges on the tuition amount and there was no reponse. i have now given a check to the school for the original tuition amount of 5700.00 my question is can the lawyer continue to sue me for the 2000.00 in so called interest or by cashing the check have i been cleared of the debt the tuition was for the school year which ended in june 2005.

They can pursue you for the balance...You should not have paid anything without an agreement in writing as to what amount you would be responsible for. The partial payment validates their claim and if they can prove they are entitled to the difference, you would have to pay. Judges tend to be a little sympathetic to individuals they perceive to be hard pressed financially, and if you go to court, a Judge might judge feel you paid enough...but legally, you should not have paid anything until you hammered out a deal in wrting....In new york, interest accrues on debts at 9% per annum...they don't hve to tell you...its the law.
