is it illegal to tape without permission a conversation in new york?

Not as long as the party taping the conversation is a party involved in the conversation.

The fourth amendment, and its progeny were designed to protect citizens from state and federal agents. Thus, if the taping was done by a privite citizen your best recourse would be to bring a civil action for invasion of privacy. However, if your claim does not meet the requirements for invasion of privacy in NY you will not be successful.
