You pretty much need to get an attorney. I don't practice in NY but I can probably refer you to some good attorneys if you wish.

By not taking the tests you will give up your privilege to drive in N.Y.That being said it does limit the evidence that will be produced against you at trial.It will also hinder your or your attorney's ability to plea bargain.
