Legal Question in Family Law in New York

Court Date

If my husband keeps missing court dates and meetings to settle our divorce through supreme court, is there anything my attorney and I can do about it to speed up the process? Can I still see the judge even if he's not present?

Re: Court Date

Hi:

Since you are represented by counsel it is unethical for me to comment on your case. That being said I really believe you should address these very same issues with your counsel. Hypothetically, if someone has a track record of missing court dates, then at the next one, before the Judge adjourns again, I would request that he mark the case FINAL. Further, if I had a case with similar facts, I would look to bifurcate the proceedings, ie request the judge to grant the divorce with a date certain for trial on the equitable distribution issues.

Good Luck
