Filing a Lawsuit in NYC

We were involved in a car accident on May 26th 2007 in NYC with a Hertz rental car that hit our car a 2007 leased Lexus IS250 awd from the rear.

Geico sent an adjuster down to adjust the vehicle. The adjuster notified us of that he adjusted the damages for more the $15,000 and a check was sent to the collision shop in the name of Kenneth Herbert and Broadway Auto Collision.

The collision shop took the liberty of endorsing Kenneth name and cashing the check.

Originally the collision shop said the vehicle would take about two weeks. Then he said 4 weeks. On July 2nd we visited the shop and there was little to no work done one the vehicle. The shop promised the vehicle would be another 2 weeks for completion and we agreed. On July 11 we called to see the status of the vehicle and were told that he had no clue when the vehicle would be complete. The work was coming along nice and he had got as far as putting a headligh

You failed to ask a question. However you can file a lawsuit in the Fourth District Court in Hicksville on Bethpage Road or in Hempstead in the first District court. You should however get an attorney.

You may also want to refer the fraudulent conveyance of the check to the local police or to the District Attorney's complaint bureau in Mineola, NY.
