small claims court

Can a defendant represented by legal aid atty in criminal case that was dimissed without prejudice ,then sue the complainant (me) in small claims court for legal fees for a consultation with private atty?

Yes, he can sue you and make the claim. However, he'll lose, unless he can prove that your complaint was both completely without merit and made solely for the purpose of harming him.

I agree; he can sue you but that doesn't mean he'll win, unless you were foolish enough to not defend yourself.
