Legal Question in Insurance Law in New York

auto accident responsibility

my 17 year old daughter was in an accident, but she was not driving. the car is in my husbands name and so is the insurance. She allowed a boy to drive and he rear-ended someone. she got scared and climbed in the front seat and told the police she was driving. no report was filed because they knew the kid that they hit. and no one was injured. she told us she was driving too so we reported it to our insurance but the damage has not been assessed yet. just now she told us that she wasnt driving the car. what do we do? is this kid responsible for the accident because he was driving? does he have to pay for the damage to our car and the other one? we want to do the right and legal thing, and we feel this kid or his parents should pay, but we dont know how to go about doing this. should we call an attorney first or the insurance company?

1. Since he was driving your vehicle with permission you are responsible.

2. Yes, you should call your insurance carrier & advise them what occurred.
