Legal Question in Landlord & Tenant Law in New York

improper living conditions

I am currently a tenant andhave beenliving at the same location for the past 4 years.For 3 of those 4 years our spetinc systemhas been backingup in the front yard. Theonly way I could intice the landlord to fix the problem was to stop paying rent. It has been 2 months and the problem is still not fixed. If I get evicted and have to gotocourt for back rent, will I be liable to pay the back rent (only 2 months) and move out eventhough the town code enforcer and the county health department have determined that we should not be living on the premesis since there is standing water (sewage)in the yard? I also have 2 children (ages 5 and 3) and my fiance living on the premesis with me. My main concern is that my family will get sick

You should not have to pay ent for the time the premises has been uninhabitable however to be safe you should keep your rent money in a separate account till there is a determination by a judge.
