Tenants lease Expired in 9.01.06

they did not renew in this 6 family property

couple was divorced

now wife wants new lease, do I keep same old rate or raise? How does it work

In writing a new lease you may chose to charge a higher fee, unless there was any agreement in the previous lease as to future lease rates which may be a point for litigation, you have nothing to limit yo from charging a reasonable increase.

As it is a 6 family you may be subject to rent sabilization. Contact us or another lawyer to give the full facts and tomake an informed decision.

If you are subject to Stabilizatin you MUST offer a lease. If you offered a lease previously and they did not renew within five months you can remove them only if you accepted no rent after the prior lease ended.
