Legal Question in Medical Malpractice in New York

Eclampsia

On Nov.26, 2000, I suffered four seizures while being 36 weeks pregnant. I had an emergency c-section. When I finally awoke, I was told I had eclampsia and that my baby had to be taken. My doctor never diagnosed me with pre-eclampsia. Two months prior to the attack, I repeatedly phone my doctor and complained of swelling, pain and headaches. He told me it was normal. Two days before my seizures, again I asked him to see me because I felt something was wrong. He told me to wait until my next visit which was in a week. Needless to say, I did almost make it to next week. My blood pressure was extremely high and I was at the point of a stroke. Six months later, I am still having headaches and my right arm goes numb and gets stiff. Can my doctor be held responsible for neglecting to properly care of me?

Unfortunately, the facts are too sparse to give you proper advise over such a limited forum.

As an aside, in order to begin such an action, a doctor must reveiew your medical records to ascertain if there MAY be malpractice, not that there is. The statute of limiations in such matters is generally 2 1/2 years from the incident.
