Legal Question in Medical Malpractice in New York

Ovarian Tumor

Went to ob/gyn complaining of severe bloating, irregular periods & severe mood swings just prior to period. DR ignored symptoms & brushed it off w/out any tests or followup. Went to primary thru the year off & on as my symptoms got worse. I went back to the ob/gyn again the following yr complaining of a bloat that now seemed permanent & severe mood swings daily. She blew me off again. Later when a pap had come back abnormal she did another exam & felt a tumor. This tumor she estimated by size had been growing (her est.) since 2002. It was large enough for her to tell immediately she thought I was 4 months pregnant (yet 2 wks before she missed it??). If this had been growing since then & I was going for annual exams (including internal pelvic) & complaining yet nothing was done. After the tumor was found benign w/extreme high estrogen (causing mood swings) I had a laparotomy resulting in a 9 inch scar, removal of my ovary, fallopian tube and appendix. I'm in my early 30's. I had made complaints to the dr that were ignored & that I went for routine exams this should have been caught early & I should have never have had to go thru the surgery & perhaps early enough my ovary most likely would have been saved.
