Legal Question in Real Estate Law in New York

Good Day,

I live in nyc, I just found out yesterday from an inspector after filing an order to repair agianst my land lord that my basement apartment is an illegal cellar. ( I was not aware of this as I'm not from nyc. I'm now expecting a vacate order. we have court date in a couple of wks. Am I entitled to all the rent paid and/or relocation expences. Please advise

Landlord is not entitled to collect rent unless you pay it voluntarily. He cannot enforce payment in civil court. He has to go to supreme court to get you out unless a vacate order is issued by the building dept.you cannot recover rent already paid.
