Legal Question in Workers Comp in New York

Can we file a valid law suit against this company

Hi, Im writing to you to inquire about my rights as a employee to sue my current employer. I have had no history of asthma in the past (im 44 yrs old) and now after working for this company for almost 4 yrs have acquired it. Im allergic to narcotics that they manufacture and my supervisors know about it. I have severe breathing problems to it. And not too long ago, I had a really hard time breathing after working with that product and my systolic blood pressure was above a 210 and the nurse and other company officials sat me in the nurse's office without sending me to the ER. I wanted to go home but they refused to send me home early and after the days work, my son drove me to the er at which point i was totally breathless. Shouldnt the company have sent me to the hospital? And the next day, i received about 10 calls from the company bosses, inquiring about my condition. They asked me to go to their doctor for an evaluation,which i did. I just want to know what i should do at this point? I have no knowlegde about the legal issues so please reply asap

I recevied your post on 7-2-2001.

You cannot sue an employer for work related inhuired, unless certaincircumsatnces are present. It will be a worker's compensation claim.

You'll need a lawyer, whose fees are paid out of each award and approved by the judge.
