It is either harassment or it isn't. What it is 'considered' to be could be either depending on the intelligence of the person doing the subjective considering. If the neighbor is doing it purposely with the intention to harass you then it is harassment. If not - then it isn't. Of course, in order to do anything about it from a legal perspective, you have to prove the neighbor is doing it purposely with the intention to harass you or at the very least make that allegation to law enforcement or your local magistrate. That is if you want to limit yourself to your legal options.
