It is either harassment or it isn't. If the neighbor is doing it purposely with the intention to harass you then it is harassment. If not, then it isn't. Of course, in order to do anything about it from a legal perspective, you have to prove the neighbor is doing it purposely with the intention to harass you or at the very least make that allegation to law enforcement or your local magistrate.
