Legal Question in Credit and Debt Law in Pennsylvania

I'm getting harrassing calls from Niagra Credit Solutions over a Judgement that was filed in 1998 and re-filed in 2006. This debt is NOT showing on my credit report as it was charge off and they are demanding that I pay them the outstanding debt at a reduced rate. Would they have the power to garnish my wages and/or place a lein on my property if I chose to ignore them??

You shouldnt ignore this if they are harassing you. Harassment is a violaton of debt collection laws. You may be able to sue them, and that may assist you in dealing with the underlying debt.

You should contact a consumer law firm, whether its my office or another, for a free review. You will need to specifically describe the harassing phone calls.

To answer your question, no, they cannot garnish wages while your employer has those funds. Once the wages are deposited into your bank account, they are no longer wages and may be subject to garnishment.
