Some states will not allow you to be divorced until you have been legally separated for a specified period of time. Usually this means that a document has been signed by the parties indicating the date of separation. Pennsylvania is not one of these states. In Pennsylvania, the grounds for an uncontested divorce are either a two year separation or consent of the parties.

In pennsylvania a separation occurs when the parties are physically living apart. This can be in the same residence but is often difficult to prove in divorce actions where date of separation is relevant. The parties can also and often enter into a separation agreement which is a written agreement which spells out the terms of the separation. Who takes what property, who will pay what bills, isues of support,etc. You can have an attorney draft an agreement for you. However both parties must sign and agree to the terms of the separation.
