Legal Question in Sexual Harassment in Pennsylvania

Need to Know if I have a valid case

My question is: I was sexually harrassed in the office I work in by a courier who came into the office daily. I REPEATEDLY told him no and REPEATEDLY asked my boss to make him stop. She did nothing about it and is now trying to place me under review for being ''rude'' to this man. Isn't it her job to protect her employees from harrassment? Do I have a case against her?

Although sexual harassment claims usually involve unwelcome behavior from co-employees an employer may be responsible for actions of non-employees in the workplace under certain circumstances. If your employer has the right to control the messenger's behavior or ban him from the property, you may have a claim if they do nothing in repsonse to your complaints. You may also have a claim for retaliation if you suffer a job related loss as a result of making complaints.
